Both the property and the peers of men, in some circumstances women were considered to possess no powers, rights, or duties in law, and in others were judged morally, practically, and intellectually fit to own property, conduct business, engage in lawsuits, and manage their own personal affairs. Wegner spells out in detail these variations in status, analyzes them, and isolates the factors that account for differential treatment of different classes of women in the private domain and for differential treatment of men and women in the public domain of mishnaic culture, relating her findings to recent developments in feminist analyses of the status of women in patriarchy.

Clarifying the Mishnaic status of women

Wegner tries to understand the status of woman as given in the Mishnah. Her major point is that it is by and large determined by her sexual status. A minor girl is under the authority of her father, a married woman under that of her husband. The father can sell the daughter to her prospective husband. The wife must undergo the trial of 'Sotah' at suspicion of infidelity, whereas there is no such demand of the husband.

Wenger claims that women , such as the girl who attains adult status, the divorcee, who are not under the sexual jurisdiction of a man have prerogatives and freedom.

Wenger too points out however the privileges and respect the system gives to women, the way the Torah protects the woman by such means as Ketubbah, and by the Halachic demands made upon the husband to provide for his wife's sexual needs, her food and clothing, her standard of living at least as high as it was previously.

Wegner says that women in the Mishnah have mixed status often, combining elements of being chattel and of being independent respected persons.

Chattel or Person : The Status of Women in the Mishnah

Knowing the complexities associated with studying Jewish Law, especially those laws based on gender, this book is an asset to you library.
Wegner explains these laws, offers a variety of Rabbinic commentaries throughout the centuries as well as modern day feminist interpretations and arguments. Her easy to follow commentary makes understanding the history of the Mishnah and purpose of these laws a comprehendable process for the professor as well as the students of the Mishnah. I would highly recommend adding this book to your library, preferably in hardback, seeing how you will refer to it time and time again.

Interesting and Useful

A better title might be, "A Feminist Look at the Treatment of Women in the Mishnah".

The author makes no attempt to hide the fact that she is a feminist and some of her conclusions reflect her feminist philosophy rather than the facts presented. The author also gives clear indication that she does not consider Scripture as devine revelation but apparently the work of men. If the reader keeps these things in mind he should find that the book IS very interesting and may be helpful in seeing how the rules of the Mishnah relate to women.

The author provides many of her own interpretations of Scripture and the Mishnah, some of which I find in no other place and stand in sharp contrast to other commentaries I've read. One significant passage where the author appears to add her own twist is Numbers 30:2-17. She regularly adds conditions associated with sexual relations that are not found in the text and must be presumed, at best. The JPS Torah Commentary: Numbers (English and Hebrew Edition)

The book appears to be well researched and well organized. The author presents the rulings regarding women in a very systematic and logical organization. She covers many combinations, special conditions and circumstances of women and how the sages addressed them. It can get a bit confusing when she presents the contradictory rulings of different rabbinical schools but that is the nature of the issue.

I do recommend the book for some good insight into how Jewish society see and deal with women.

As a matter of full disclosure: I am a conservative Christian. I research Jewish thought because of our common heritage, but I must admit that I know too little of Hebrew and Jewish thought - thus this reading. I have some serious disagreement with many of the author's conclusions.

Should the author ever revise the book, and I hope she does, I would like to suggest a couple things:
- The end notes are excellent and I believe should be read. I would, however, have preferred them to be footnotes rather than endnotes. The constant flipping to the back is a bit of a distraction. The notes would fit well in the text as footnotes.
- I would like a chapter or appendix that looks at the examples in the historical narrative of Scripture and compares the historical event with the rules in the Mishnah.
- Although this book was written to specifically addresses the Mishnah, there are Scriptural passages that apply to women that are never referenced. I'd like to see better coverage of the Scriptural passages since it is clear the Mishnah is based upon Scripture.
- I'd like to see a Scriptural index.
- The author does an excellent job of defining terms in the text as she introduces and uses them, however, a glossary would be a welcome addition.
